Landlord - Tenant Disputes

McAdams Law has represented tenants in thousands of landlord-tenant disputes, including dispossess proceedings for nonpayment of rent and holdovers.   In a dispossess for nonpayment, as the name implies, rent is the issue.  In a holdover proceeding the landlord demands possession of your apartment and wants to evict you, regardless of whether or not you have paid rent. 

Nonpayment proceedings and holdover proceedings are very serious, accelerated matters and often involve complex legal issues. If your landlord is trying to evict you, it’s imperative to get legal representation as soon as possible, especially if you live in a New York rent-controlled or rent-stabilized apartment. Rent-controlled and rent-stabilized apartments are increasingly scarce and have become precious assets that can provide a permanent home for you, your children, even your grandchildren or nontraditional family memebers, for lifetimes to come.   Regardless of why your landlord is trying to evict you McAdams Law can quickly join issue for you to help you stay in your apartment for as long as possible.

If a landlord overcharges you, or violates a covenant of your lease such as the warranty of habitability, or tries to break some other tenant protection in landlord-tenant law, McAdams Law can assert your rights by initiating a new claim or filing a counterclaim in a pending proceeding (for example, in a dispossess proceeding against you).   For one tenant who had not paid rent in nearly a year Jeffrey McAdams brought a counterclaim for overcharging the legal, regulated rent and obtained summary judgment for over $120,000 in favor of the tenant.  In another rent overcharge case McAdams Law secured the waiver of over a year’s rent arrears in addition to a rent reduction rent for his client. Personal Injury

McAdams Law handles personal injury cases, including car accidents, dog bites, and slip and fall accidents (also known as premises liability). The law firm represents injured plaintiffs as well as individuals and small businesses that are being sued. McAdams Law never represents insurance companies.

Jeffrey McAdams represents Community Organizations and Radio Dispatchers.   One of the  Organizations he has helped is a Community Center that a City Inspector sued for injuries he suffered while doing his job.  Radio Dispatchers, which help drivers earn a living and provide access to transportation for neighborhoods that are not served by Yellow Cabs, are often sued in personal injury cases when drivers have auto accidents. 

On the plaintiff’s side McAdams Law successfully represented a worker who fell down four stories through an elevator shaft and broke his back.   McAdams Law was also involved in a case for a tenant who was injured by an elevator door when it closed on his hand.  With our interest in preserving the rights of tenants in their homes we are especially looking for cases of lead poisoning based on the new lead paint law or other injuries suffered due to defective conditions in apartments.
